Discover your rights as a passenger when travelling

WHAT DOES EUROPEAN REGULATION SAY?

Regulation 261/2004 of the European Union states that passengers are entitled to compensation in the event of a delay, cancellation, or denial of boarding due to overbooking. This regulation applies to all flights departing from an EU country or operated by an airline based in the EU, regardless of the destination.

According to the legislation, compensation may range between €250 and €600, depending on the flight distance:

  • €250 for flights up to 1,500 km.
  • €400 between 1,500 and 3,500 km.
  • €600 for flights over 3,500 km.

If your flight has suffered a significant delay, you can request compensation for a delayed flight from the airline responsible. Similarly, if your flight has been canceled without prior notice and no reasonable alternatives have been offered, you may file a claim for flight cancellation and demand appropriate financial compensation.

HOW TO CLAIM COMPENSATION FOR A DELAY OR CANCELLATION?

If your flight has been canceled or delayed for more than three hours, you can file a claim directly with the airline. To do so, follow these steps:

  1. Keep all documentation: Save your flight ticket, boarding pass, and any emails from the airline regarding the incident.
  2. Request written justification: Ask the airline for a document stating the reason for the delay or cancellation.
  3. Record flight details: Note the actual departure and arrival times, as well as any announcements from the airline at the airport.
  4. File a claim: You can do this directly with the airline or through specialized companies that handle these types of claims.

If the airline does not respond within six weeks or rejects the claim without valid justification, you can approach consumer protection agencies or initiate legal proceedings.

WHEN IS COMPENSATION NOT APPLICABLE?

There are exceptional circumstances where the airline is exempt from paying compensation. These include:

  • Adverse weather conditions preventing a safe takeoff.
  • Strikes by airport staff or air traffic controllers.
  • Security alerts affecting flight operations.
  • Unexpected technical issues that are not attributable to the airline.

However, the airline is still required to offer assistance and alternative transportation to affected passengers.

ADDITIONAL PASSENGER RIGHTS

In addition to financial compensation, affected passengers are also entitled to:

  • Airport assistance: If the delay exceeds two hours, the airline must provide food, beverages, and, if necessary, accommodation.
  • Ticket refund or alternative transport: In case of cancellation, the passenger can choose between a full refund or an alternative flight to their destination.
  • Additional compensation for damages and losses: In some cases, if the delay or cancellation has resulted in significant financial losses, additional compensation can be claimed.
